Consignment

Consignment terms

Version of 5 November 2026. The short version is on the Consignment page.

§1 Parties and subject
  • The service is provided by Archive Ignacy Staszewski (VORHE), ul. Śląska 46B/17, 41-100 Siemianowice Śląskie, NIP 6351866478, contact@vorhe.co, +48 731 343 830.
  • Consignment (Art. 765 of the Polish Civil Code): VORHE sells the consignor’s piece in its own name and on the consignor’s account. The consignor remains the owner until the sale. An agreement and an item card are concluded for every piece, as a rule by email: before sending the piece the consignor receives the agreement, these terms, the item card and the withdrawal form as PDF files and accepts them.
  • The submission form and the calculator on our website are free electronic services provided under the store terms (§7).
§2 Who can consign
  • Adults (18+) and businesses based in Poland.
  • Before intake we confirm the consignor’s identity: on a short video call with an identity document, or with a PLN 1 verification transfer from their own bank account. We note the name and document number; we do not copy the document.
  • We pay out only to the consignor’s bank account confirmed during verification.
  • The consignor declares that the piece is their property, authentic, not obtained through a crime and free of third-party rights. For pieces above PLN 5,000 we ask for proof of purchase or other proof of origin.
  • We may decline without giving a reason, in particular when the origin of the piece raises doubts.
§3 Acceptance
  • Authentic designer clothing, footwear and accessories, with no holes or permanent stains; a piece that needs cleaning may be sent to a laundry (see the point on cleaning); footwear in very good condition. Starting price at least PLN 1,500.
  • Shipping to VORHE is at VORHE’s cost: we send the consignor a prepaid label (InPost or courier), insured for a declared value equal to the consignor’s share at the starting price on vorhe.co (stated in the item card), and for larger collections we book a courier pick-up. We file any claim with the carrier ourselves. If the piece is lost or damaged on its way to us, VORHE pays the consignor that amount within 14 days of the end of the claim with the carrier and no later than 60 days after dispatch, whether or not and however much the carrier pays. This does not apply to damage caused by packing against our instructions, sending a piece other than the one submitted, or lack of proof of dispatch. If the amount exceeds the carrier’s insurance limit, we accept the piece only by courier with adequate insurance or in person. The piece can also be brought in person by appointment.
  • We authenticate every piece. If a piece clearly differs from the submission (e.g. undisclosed flaws, missing extras, a different model), we send the consignor photos and the unboxing video; the consignor may accept a new valuation or take the piece back. In that case the consignor reimburses the actual cost of the label the piece came on (stated in our email) and the return shipping. If a piece matches the submission and we still do not accept it, we send it back at our cost. Doubts about authenticity: §8.
  • Photos are taken by VORHE’s photographer at the next session; we give its date in the condition report. For the session we hand the piece over to the photographer and remain responsible for it then and in transit. We list the piece within 7 working days of its return from the photographer, no later than 45 days after intake. If we miss that deadline, the consignor may withdraw from the agreement for that piece at no cost and we send it back at our expense. For consumers we list it within the 14-day withdrawal period only if they expressly ask us to (§14); otherwise after that period.
  • We open every parcel on video. Within 3 working days of delivery we email the consignor a condition report with photos. The consignor may raise objections within 7 days; silence does not prevent the consignor from proving a different condition. Each piece gets a number (K-0001…).
  • Cleaning. If a piece needs cleaning when it reaches us, we may send it to a laundry we work with. VORHE chooses the laundry. Before sending the piece to the laundry, we email the consignor photos and the cost. Without the consignor’s consent we do not clean the piece. In that case we treat it as a piece that clearly differs from the submission: the consignor reimburses the cost of the label the piece came on, and we send the piece back at the consignor’s cost, or the consignor collects it in person free of charge. The cleaning fee is PLN 100 gross (including VAT) for handling, plus the laundry’s cost as invoiced. We deduct the fee from the payout for that piece. If the piece does not sell or is withdrawn, we settle the fee on collection or when the agreement ends, like the cost of photos. The risk of damage at the laundry lies with the consignor. VORHE is not liable for such damage unless it results from VORHE’s fault, e.g. wrong instructions to the laundry. If the laundry is liable for the damage, we claim compensation from it and pass it on to the consignor.
§4 Price
  • We agree the starting price with the consignor.
  • If the consignor agrees, the price drops by 10% of the starting price on day 90 and again on day 180 from listing. The price after the second reduction is the minimum price, written in the agreement. Without reductions, the minimum price is the starting price.
  • The minimum price applies on every channel; on marketplaces we convert it into the marketplace currency at the rate under §6 on the listing day. Without the consignor’s consent given by email or message we do not sell, or accept an offer, below the minimum price. Offers at or above the minimum price we may accept ourselves.
  • The consignor may lower the price at any time by email; a higher price needs our agreement.
  • On marketplaces we may list higher than on vorhe.co to offset their fees; the consignor’s share is then calculated from the sale price on the marketplace.
§5 Your share and VORHE’s fee

For every piece sold the consignor receives a fixed share of the sale price. The sale price is the price of the piece the buyer agreed to, also after we accept their offer. It does not include shipping, taxes, duties or fees the buyer pays to a marketplace. Discounts, codes and promotions from VORHE or a marketplace do not reduce the consignor’s share: we calculate it from the price before the discount.

  • Sold on the vorhe.co store: 70%, or 75% if the sale price is above PLN 5,000.
  • Sold on a marketplace (Grailed, eBay, Vestiaire Collective): 60%, whichever marketplace and wherever the buyer is.

The rest is VORHE’s fee. From it VORHE covers all costs of the sale: marketplace commissions, payment and currency conversion fees, shipping the piece to VORHE, insured shipping to the buyer, valuation, photos, descriptions, listing, storage, advertising, buyer support and customs paperwork. The consignor pays nothing else for the sale. The statement shows where the piece sold, with the order confirmation.

Costs the consignor may bear only in these situations:

  • early collection after the withdrawal period: the cost of photos already taken (PLN 32 per piece, at most PLN 64 with extra photos) and return shipping (§9),
  • after the agreement ends: return shipping, and storage of PLN 20 per week after 30 days (§10),
  • a piece clearly different from the submission: the label it came on and return shipping (§3),
  • cleaning at a laundry that the consignor agreed to: PLN 100 gross for handling plus the laundry’s cost as invoiced (§3),
  • a counterfeit piece or a piece of illegal origin: verification costs and damage (§8),
  • a return or complaint caused by the consignor’s inaccurate information: §7.

For collections of at least 10 pieces or PLN 20,000 in total, the shares may be set individually in the agreement. The amounts we email after every price change are information, not a guaranteed payout.

§6 Payout and documents
  • We pay within 7 days of the later of: the end of the buyer’s return period (vorhe.co: 14 days from delivery; marketplaces: under their rules, at most 30 days) or the release of funds by the marketplace, and no later than 45 days after the sale. If a marketplace or payment provider withholds the funds (e.g. because of a buyer’s claim or for reasons unrelated to the piece), we tell the consignor by email and pay within 7 days of the funds being released; if a hold unrelated to the piece or the consignor lasts longer than 90 days from the sale, VORHE pays from its own funds. We pay by bank transfer to the account given in the agreement, with a statement. If, before the payout, the buyer opens a return, complaint or dispute, the payout period runs from its closure; if the piece comes back, no payout is due and the piece goes back on sale.
  • The consignor’s share is calculated in the currency of the sale and converted to PLN at the NBP average rate (table A) from the last working day before the sale. Currency conversion costs are borne by VORHE. The PLN amount is calculated this way even if it is below the minimum price in PLN; the exchange-rate risk lies with the consignor.
  • Private person: no document, our statement. VAT-exempt business: an invoice without VAT for the amount in the statement. Active VAT payer: an invoice for the amount in the statement, which includes VAT (gross); a piece bought under the margin scheme is invoiced under the margin scheme. As the date of sale (supply) they enter the date the piece was sold, stated in our statement. Business invoices are issued in KSeF where the law requires it.
  • The consignor settles their own income tax.
§7 Returns, complaints and chargebacks
  • As the seller, VORHE handles buyers’ returns and complaints. A piece returned before the payout goes back on sale on the same terms.
  • If, after the payout, a buyer returns the piece, a complaint is accepted or a payment is reversed because the piece is not authentic, has a defect the consignor knew about or did not disclose although it was visible, or does not match the information the consignor gave — the consignor returns the amount received and VORHE’s documented costs (marketplace fees, shipping). VORHE may raise this claim within 2 years of the sale and deduct it from later payouts.
  • In all other cases (e.g. buyer fraud, a parcel lost or damaged on its way to the buyer) the risk is VORHE’s, and the consignor receives their share as for a sale. If a piece comes back after the payout for reasons the consignor is not responsible for, the consignor keeps the payout and the piece becomes VORHE’s property.
  • The cause of a return, complaint or reversed payment is determined from the decision of the marketplace or payment provider and the condition report; the consignor may prove otherwise.
§8 Authenticity and origin
  • We check the authenticity and origin of every piece at every stage: on intake, before listing, before shipping to the buyer and after a return from the buyer. We may use an external authentication service or ask the brand.
  • We sell the piece in our own name and are responsible for it towards the buyer, so VORHE decides whether to list and sell it. If at any stage we have reasonable doubts about a piece’s authenticity or origin – from our own checks, an authentication service, a platform, the brand or the authorities – we suspend its sale and the payout and may terminate the agreement for that piece with immediate effect. We give our reasons by email; the consignor may provide evidence (e.g. proof of purchase), which we will take into account.
  • After terminating the agreement for this reason we send the piece back to the consignor or hand it over in person, unless the law or the authorities require us to keep it – in that case we hand it over to the competent authorities. We do not charge for photos already taken. Unless the piece is found to be counterfeit or of illegal origin, VORHE covers the return shipping and the verification.
  • If the piece turns out to be counterfeit or of illegal origin, the consignor covers the cost of the verification and the return shipping and compensates VORHE for the damage (refund to the buyer, fees and other direct, documented costs; for a consumer acting in good faith, up to the sale price of the piece).
  • If we resolve the doubts in the consignor’s favour before terminating the agreement, we resume the sale and VORHE bears the cost of the verification.
§9 Term and ending
  • The agreement runs for 12 months from listing. 30 days before the end we send a summary and offer a 6-month extension with a new price, or the return of the piece. If the consignor does not reply by the end, the agreement ends and §10 applies.
  • Within 14 days of concluding the agreement a consumer may withdraw under §14. After that the consignor may take the piece back at any time, unless it has already been sold. We take the listings down within 2 working days; an order placed in that time is completed under the agreement. If the photos have already been taken, the consignor reimburses their cost – PLN 32 per piece (4 photos) plus PLN 8 for each extra photo we took at our discretion to show the piece well (at most 8 photos, i.e. PLN 64) – and pays for insured return shipping unless collecting in person. If the piece was cleaned with the consignor’s consent, we also settle the cleaning fee (§3). No other fees.
  • VORHE may terminate the agreement for a piece early only for a good reason: if the piece clearly differs from the submission (§3), if there are reasonable doubts about its authenticity or origin (§8), or if the consignor breaches the agreement. We give the reason by email. If VORHE ends the agreement, the consignor does not pay for photos already taken; VORHE covers the return shipping, except for a piece that differs from the submission (§3), a counterfeit piece or one of illegal origin (§8), and a breach of the agreement by the consignor.
  • Return of the piece: by insured courier at the consignor’s cost, unless these terms provide otherwise (§3, §8, §9, §14). The consignor sends us a prepaid label, or we order a GlobKurier label and the consignor pays for it by transfer before dispatch. We document the packing with photos and video. Collection in person by appointment is free, with a handover report signed. VORHE is responsible for the piece until it is dispatched or handed over. If VORHE orders the label, the declared value is the consignor’s share at the current price unless the consignor specifies another; in case of damage VORHE files the claim and passes the compensation to the consignor or, at the consignor’s request, assigns the claim against the carrier to them.
§10 Uncollected pieces
  • After the agreement ends we ask the consignor to arrange the return of the piece (a paid label) or collect it within 30 days. After that, storage costs PLN 20 per week, in total no more than half of the minimum price (Art. 769 §2 and Art. 551 of the Civil Code).
  • If, 90 days after the end, the consignor has neither arranged the return nor collected the piece, VORHE sets a final 14-day deadline by email and by text message or registered letter to the address in the agreement. After it expires, VORHE may sell the piece on the consignor’s account, lowering the price by 10% every 30 days, but not below half of the minimum price. If it does not sell even at that price, we send it to the address in the agreement and the consignor reimburses the shipping and storage costs within 14 days. From the price we deduct only our fee under §5 and the storage costs due, and pay out the rest within 7 days.
  • VORHE has a statutory lien on the piece for its claims (Art. 773 of the Civil Code).
§11 Storage and liability
  • Clothing is kept in breathable garment bags, footwear and bags in dust bags, separate from VORHE stock. We document the condition at intake, at every price change and before shipping.
  • VORHE is liable for loss of, destruction of and damage to the piece from its delivery to VORHE until it is dispatched or handed over to the consignor or the buyer, unless the damage results from force majeure (e.g. fire, flood) or from circumstances for which VORHE is not responsible despite due care. Compensation for loss or destruction is the consignor’s share at the current price on vorhe.co. If the piece is damaged, VORHE has it repaired by a specialist at its own cost, or pays as for loss if repair is impossible or the consignor does not want it.
  • After the agreement ends and the period under §10 has passed, the piece is stored at the consignor’s cost and risk (Art. 769 §2 and Art. 551 of the Civil Code), and VORHE is liable only for intent and gross negligence.
  • VORHE is not liable for normal ageing of materials not caused by storage, or for defects that existed at intake. Liability for damage at a laundry is set out in §3.
  • Deadlines in these terms and the agreement are extended by the duration of force majeure or of an outage of a marketplace, payment provider or carrier beyond VORHE’s control. This does not limit consumers’ statutory rights.
§12 Sales abroad

Most of our buyers are in the US and elsewhere outside the EU. Marketplaces charge 14–20%, and every parcel leaving the EU is an export (customs declaration, proof of export IE599, insured express shipping). VORHE handles all of it and covers it from its fee, so the consignor’s share depends only on whether the piece sells on vorhe.co or on a marketplace.

§13 Remote consignment for resellers

For businesses only, with at least one large parcel of pieces (usually 4–8) listed from PLN 1,000, under a separate consignment agreement. The stock stays with the partner, who prepares item cards, stores and packs the pieces and ships orders within 2 working days. The partner is responsible for the pieces it keeps, their match with the description, packing and timely shipping, and covers the costs of returns and complaints caused by its errors. Photos are taken only by the VORHE photographer at a fixed rate of PLN 32 per piece (4 photos; each additional photo PLN 8 with the partner’s consent), deducted from the payout for that piece or, if it does not sell, on withdrawal or when the agreement ends; by paying for them the partner buys the rights to them, but may use them outside VORHE only after the piece is withdrawn from consignment or the agreement ends. The partner may also sell the pieces on its own account, without VORHE branding and without those photos, and reports every such sale to VORHE straight away.

The partner receives a fixed share of the sale price: 80% for sales on vorhe.co and 70% for sales on a marketplace (Grailed, eBay, Vestiaire Collective), unless the agreement says otherwise, plus the shipping fee paid by the buyer, less the marketplace commission charged on shipping. VORHE arranges labels on request free of charge and deducts the shipping cost from the statement; shipments outside the EU always go on a VORHE label (VORHE as the exporter). Settlement twice a month, against the partner’s invoice. The partner bears the risk of loss of and damage to the pieces until they are delivered to the buyer, except while a piece is with VORHE or its photographer; contractual penalties, VORHE’s liability cap and the rules on returning payouts after reversed payments are set in the agreement. §4, §7 and §8 apply accordingly to remote consignment; §5 and §6 do not – shares and payouts are set in the agreement.

§14 Withdrawal (consumers)

A consumer, and a sole trader for whom the agreement is not of a professional nature, may withdraw from the agreement within 14 days of concluding it without giving a reason, by email to contact@vorhe.co or using the withdrawal form we send with the agreement.

We list the piece within those 14 days only if the consignor expressly asks for it in the email accepting the agreement. Without that request we list it after the 14 days, and withdrawal costs nothing, except the cleaning fee if the consignor agreed to cleaning (§3). If the consignor asked us to start and then withdraws, they pay for the work already done, i.e. the cost of photos under §9 (PLN 32 per piece, at most PLN 64) and, if they agreed to it, the cleaning (§3). If the piece is sold before withdrawal, the service is fully performed and the right of withdrawal expires; the consignor acknowledges this in the email accepting the agreement.

After withdrawal we return the piece within 14 days at our cost, by insured shipment or for collection in person. We do not ask for the cost of the label the piece came on.

§15 Data, complaints and final provisions
  • Personal data: see our Privacy policy. Agreements and statements are kept for as long as tax law requires. Copyright in photos commissioned by VORHE belongs to VORHE, subject to §13.
  • The consignor tells us about any change of email, phone or bank account. A message sent to the last email address given is treated as delivered, except the final notice under §10, which we also send by text message or letter.
  • Complaints about our service: contact@vorhe.co. We reply within 14 days.
  • A consumer may resolve a dispute out of court, e.g. through the Provincial Inspectorate of Trade Inspection in Katowice (WIIH) or with the help of a municipal or district consumer ombudsman.
  • Changes to these terms do not apply to agreements already concluded if they are to the consignor’s disadvantage. Polish law applies; consumers keep all rights given by law. In case of discrepancies between language versions, the Polish version prevails.
